The following details are believed to be true but should not be totally relied upon:
Testator: son of Richard (1590/91 qv) & Joyce (1608/09 qv)
His "cousin" Elizabeth, dau of brother John, is presumably his niece.
The default legatees, if everyone else dies, are "the eight heirs of me the said William" -- whatever that may mean.

  • I bequeath . . . my body to the earth from whence it came.
  • I will that there shall be £18 yearly during four years paid out of my lands in Clanfield to pay the debt which I do owe unto my brother-in-law William Whitfield as appears by four several obligations under my hand and seale.
  • I give all my Lands Tenements and Hereditaments with their appurtenances lying in Clanfield aforesaid unto my son John Busbie & to the heirs of his body lawfully begotten and for default of such issue I will the said Lands Tenements and Hereditaments do remain unto my son Thomas Busbie and to the heirs of his body lawfully begotten and for default of such issue I will the said Lands Tenements and Hereditaments do remain to my cousin Elizabeth Busbye daughter of my brother John Busby and to the heirs of her body lawfully begotten, and for default of such issue I will the said Lands Tenements and Hereditaments do remain unto my sister, Anne Holden and to the heirs of her body lawfully begotten and to be begotten and for default of such issue I will the said Lands tenements & Hereditaments do remain to the eight heirs of me the said William for ever.
  • I give the Tenement with the appurtenances wherein I dwell within the City of Oxford together with all the wainscot benches, portals, glass casements and the long table and the frame and eight joined stools therein and also all my Lands Tenements and Hereditaments with the appurtenances lying and being in Ascott-under-Wychwood, Charlbury and Swarford alias Salford in the said County of Oxford unto my son Thomas Busbie and to the heirs of his body lawfully begotten and for default of such issue I will the said Lands Tenements Hereditaments and implements do remain unto my son John Busbye and to the heirs of his body lawfully begotten, and for default of such issue I will the said Lands Tenements Hereditaments and implements do remain to my said sister Anne Holden and to the heirs of her body lawfully begotten and to be begotten, and for default of such issue I will the said Lands Tenements Hereditaments and implements do remain to my said cousin Elizabeth Busbye and to the heirs of her body lawfully begotten, and for default of such issue I will the said Lands Tenements and Hereditaments and implements do remain to the eight heirs of me the said William for ever.
  • I will that Mary my wife shall have the rents issues and profits of the tenements and gardens which I hold by lease of the City of Oxford during her natural life, and if it shall fortune the said Mary shall die before the end and term of the years mentioned in the said lease then I do give the said tenements gardens and lease unto my said son Thomas Busby if he shall be then living, and if not then I do give the same unto my son John Busbye.
  • I will that Mary my said wife shall have the education and bringing up of my children aforenamed and the disposing of their portions until they shall come to the age of 21 years if she so long live sole and unmarried. And if she happen to marry again that then I will that the overseers of this my last will and testament with the consent of my said wife shall have the education and bringing up of them, and the disposing of their portions to the best profit and benefit of my said children until they shall come to the said age of 21 years.
  • I will that Mary my said wife shall assign and make over the Tenement and Leases which I have of Mr William Dutton Esquire lying in the parish of St Nicholas alias St Thomas within the suburbs of the City of Oxford late in the tenure of Robert Dudley, carpenter, unto six or eight of the chiefest inhabitants of Culham in the County of Oxon husbandmen, to the use and intent that they shall yearly and every year employ and bestow the rents issues & profits of the said Tenement in the said parish of St Nicholas alias St Thomas indifferently upon the poorest people dwelling and inhabiting within the said town of Culham during all the several terms of years mentioned in the said leases.
  • I give unto my said son John Busbye one? stone salt? garnished with silver and guilt and four silver spoons whereof two of them are guilt.
  • And I give unto my said son Thomas one little silver bowl and four silver spoons.
  • I give unto my maid Joan Bentley 40/- in money to be paid unto her within one year after my decease.
  • All the rest of my goods not hereby given or bequeathed, my debts legacies and funerals discharged, I give to Mary my said wife whom I make and ordain my only Executrix of this my last will and testament.
  • Overseers . . . my very good friends Mr William Wicks, the aforesaid William Whitfield and George Box of Oxford . . . and I do give to either of them ten shillings apiece for their pains.

In the name of god Amen The seaventeenth daie of
ffebruary in the yeare of our Lord god one thowsand six
hundred and eight, and in the sixt yeare of the Raigne
of our Soveraigne Lord James by the grace of god
kinge of England ffrance and Ireland defendor of

the fayth etc? and the two and forteth of Scotland I Will'm
Busbie of the Cytie of Oxon yeoman beinge sicke in bodie but
thanks be given unto Almightie god of good and p'fect remembrance
doe make and ordayne this my last will and testament in manner
and forme followinge ffirst I bequeath my Soule unto
Almightie god my maker and redeemer trustinge by the death and
passion of his sonne Jesus Christ to receave remission of my sinnes
and my bodie to the yearth from whence it came Item I will
that there shalbe eighteene pounds yearely duringe foure
yeares payd out of my lands in Clanfeild in the Countie of
Oxon to pay the debt which I doe owe unto my brother in lawe
Will'm Whitfeild as appeareth by foure severall obligacons

That Mary my wyfe shall have the rents yssues and

educacon and bringinge uppe of my Children afore named
and the disposinge of their porcons untill they shall come to
the age of one and twentie yeares yf she soe longe lyve
sole and unmaried And yf she happen to marrie againe
that then I will that the overseers of this my last will and
Testam't w'h the Consent of my sayd wyfe shall have the
educacon and bringinge upp of them, and the disposinge of
their porcons to the best p'fitt and benefitt of my said
Children untill they shall come to the said age of one and
twentie yeares, Item I will that Mary my said wyfe
shall assigne and make over the Tenement and Leases w'ch
I have of Mr Will'm Dutton Esquier lyinge in the p'ishe of
St Nicholas als' St Thomas w'hin the suburbes of the
Cittie of Oxon late in the Tenure of Robert Dudley
Carpenter, unto sixe or eight of the Chiefest Inhabitants
of Culuham in the Countie of Oxon husbandmen, to the
use of and intent that they shall yearely and ev'y yeare
ymploy and bestowe the rents yssues & p'ffitts of the
said Tenement in the said p'ishe of St Nicholas als'
St Thomas indifferentlie uppon the poorest people
dwellinge and inhabitinge w'hin the said Towne of
Culuham duringe all the severall termes of yeares
mensioned in the said Leases. Item I give unto my sayd

sonne John Busbye One? stone salt? garnished w'h silver
and guilt and foure silver spoones whereof two of
them are guilt And I give unto my said sonne Thomas
One litle silver bowle and foure silver spoones Item
I give unto my mayde Joane Bentley forty shillings
in money to be payd unto her w'hin one yeare after my
decease All the rest of my goods not hereby given
or bequeathed my debts legacies and funeralls discharged
I give and bequeath unto Mary my sayd wyfe whome I make
and ordaine my only Executrix of this my last will and
testament, And I doe request my verie good frendes Mr
Will'm Wicks thaforesaid Will'm Whitfield and George Box
of Oxford to be my overseers of this my last will and
Testament. And I doe give to either of them tenn shillinges
a peece for their paynes In Wittnes whereof I the said
Will'm Busbye have unto this my last will & testament
sett my hand and Seale the daye and yeare first
above written in the p'sence of these whose names are here
